Duration
EverTrack extends to the Original Purchaser (non-transferable) a warranty for one (1) year from the date that the order is delivered to the Original Purchaser.
Coverage
EverTrack products are warranted against defects in materials and workmanship under normal use. This warranty is void if the product has been damaged by any of the following:
- Accident, alteration, unreasonable use, neglect, or improper maintenance
- Damage in transit
- Improper or inadequate installation
- Failure to follow EverTrack's written instructions regarding care and/or operation
- Use with accessories or parts not provided by EverTrack
- Normal wear and tear, exposure to extreme temperatures, and/or damage due to environmental factors
- Any other causes not arising out of defects in material and/or workmanship
Disclaimers
Any implied warranty arising out of this sale, including but not limited to the implied warranties of merchantability and fitness for a particular purpose, are limited in duration to one (1) year. EverTrack shall not be held liable for loss or mis-use of products, failure of ceiling backing support and/or ceiling splay wires, construction code non-compliance for the aforementioned structural components, or other incidental or consequential cost, expenses, or damages incurred by the Original Purchaser or any other user. Some states do not allow exclusion or limitations of implied warranties or consequential damages, so above limitations or exclusions may not apply. This warranty gives you specific legal rights, and you may be granted rights that vary from state to state.
Remedies
The Original Purchaser should first contact EverTrack at support@evertrack.co to determine applicability of exact policies for the claim. During the one-year warranty period, the product will either be replaced or repaired at the discretion of EverTrack.
In the event of replacement, the replacement will extend the warranty of the product for six (6) months, or will continue the original warranty period; whichever period is longer.
For alternative remedies for in- or out-of-warranty services, please contact EverTrack Customer Support. No charge will be made for such repair or replacement of in-warranty products unless an alternative remedy is chosen.
